Terms of Sales

PRICE: The €uro price (excluding tax) of our products is that of our price list on the date of the order. It may be modified in accordance with regulations.

REPAIR ESTIMATES: Repair quotations are always expressed as net prices. No discount conditions are granted to resellers on repair quotations.

QUOTATION CHARGES: Quotation charges are €75 for quotations made by our technical department. The cost of quotations is €150 to €250 for quotations from the manufacturer. This fee does not apply to repairs or the purchase of new equipment (quotation fees do not apply to equipment valued at less than €50).

REPAIRS: Repairs will only be carried out once the estimate has been accepted. Transport costs to and from the site are at the customer’s expense, even if the repair estimate is not accepted. For quotation costs, see the section above entitled “QUOTATION CHARGES”.

ORDER: All orders imply full acceptance of our terms and conditions of sale. Minimum order 60.00 €uros net H.VAT, excluding SHIPPING. If this minimum is not reached, a fixed surcharge of 15.00 €uros net H.VAT will be invoiced in addition to shipping costs.

TRANSPORT: Our goods travel at the consignee’s risk. Postage, insurance and packaging costs are invoiced.
In the event of a damaged parcel, the material must be unpacked in the presence of the driver and all reservations clearly indicated on the transport note. A complaint by registered mail with acknowledgement of receipt must be sent directly to the transport company within 72 hours of receipt. Under no circumstances can SOMECO intervene in these procedures, nor can it be held responsible.

PAYMENT: Payment terms and deadlines (in compliance with the LME) are specified on our invoices. In accordance with French law no. 92 142 of December 31, 1992, in force since July 1, 1993, any delay in payment will automatically and without formality entail interest on arrears, which may not be less than 1.5 times the legal interest rate. Any invoice not contested within 15 days will be considered as accepted by the customer.

WARRANTY: Our products are guaranteed against manufacturing defects for a period of 1 year. This warranty does not apply to instruments misused or resulting from damage or accidents caused by negligence, poor supervision or maintenance, faulty installation or any other defect beyond our control. The warranty does not apply to parts such as: diamond indenters, surface condition probes, temperature probes, profile projector lenses and screens, illumination lamps for all instruments, and all wearing parts.
Used equipment is not covered by warranty.
The warranty takes effect from the date indicated on the delivery note.

CANCELLATION OF AN ORDER. Cancellation will only be effective with our agreement. An indemnity will be demanded if expenses have been incurred for the execution of this order.
RETURNS: Any return of material can only be accepted after prior agreement with our services. In the event of an accepted return, our company may, at its discretion, either repair, replace or issue a credit note corresponding to the defective equipment. The corresponding credit note will only be issued after inspection of the returned equipment in its original packaging.
For returns after 15 working days (date of B.L.), a 20% discount will be applied. This discount will be increased to 50% after three months.
NO RETURNS WILL BE ACCEPTED IN THE FOLLOWING CASES:
– After six months from the date indicated on the delivery note
– Damage to original packaging
– Appliances marked or engraved by the user
– Return carriage forward.

DELIVERY TIME: Our delivery times are given as an indication only. Delays in delivery may not give rise to claims for damages, nor justify cancellation of the order or refusal of the goods.

RESERVATION OF OWNERSHIP: SOMECO retains ownership of the equipment delivered until full payment has been made in accordance with the provisions of the law of 12/05/1980.

JURISDICTION: SOMECO sales are governed by French law. In the event of a dispute, the Bobigny Commercial Court shall have sole jurisdiction.
